Article 1 - Definitions
In these terms and conditions, the following definitions apply:
- Duetto Chat: the enterprise Limetric (CoC 54255074) operating under the stated name that offers the services described in article 2.1.
- Consumer: the natural person who does not act in the exercise of a profession or business and enters into an agreement for a paid or unpaid Membership with Duetto Chat.
- Users: the other Consumers who use Duetto Chat or sister sites.
- Website: the online platform where the services described in article 2.1 take place.
- Membership: the agreement between Duetto Chat and a Consumer for the purchase of the services described in article 2.1, whether or not against payment of Subscription fees.
- Privacy statement: the conditions of Duetto Chat regarding the processing of personal data.
Article 2 - Services
- The services of Duetto Chat consist of providing an online opportunity, through both apps and websites, to connect with other Users or to online match Users who fit together based on indicators established by Duetto Chat. Duetto Chat provides a general overview of these indicators on its website.
- Duetto Chat is transparent about the services it offers. It provides clear information about rates, automatic renewal of Membership and Website capabilities before entering into Membership so the Consumer can properly assess the offer.
- To define the target audience, Duetto Chat sets the following requirements for Consumers who wish to use the services:
- Minimum age 18 years.
- Dutch-speaking and/or English-speaking.
- The ability to connect with Users may be subject to conditions, such as purchasing a paid Membership. Duetto Chat informs the Consumer before entering into Membership about the conditions under which Users can connect with each other.
- If the services are provided against payment of Subscription fees, this is based on a fixed amount for a specific period or an amount per action or a combination thereof. Duetto Chat provides clear information about this on its Website before entering into Membership.
- Duetto Chat cannot guarantee the accuracy and completeness of information provided by Users. Users are responsible for the information they make available through the Website.
- Duetto Chat is not responsible for the behavior of Users during contact via the Website.
- Duetto Chat strives to provide services to Consumers without interruptions. Duetto Chat cannot guarantee continuous availability of services.
- When maintenance is performed on the Website, Duetto Chat will announce this in advance as much as possible and limit the inconvenience as much as possible.
Article 3 - Consumer conduct
The Consumer is not permitted to act indecently, unlawfully or in violation of the law, or to incite or encourage others to do so. For example, it is forbidden to:
- use threatening language towards Users or Duetto Chat;
- post unlawful texts, images and/or audio material;
- post texts or images and/or audio material that infringes on the (intellectual property) rights of third parties.
The Consumer is furthermore not permitted to:
- state falsehoods in the profile or elsewhere;
- impersonate someone else;
- seek or offer targeted erotic contact;
- show partial nudity, nudity or sexually suggestive content;
- show drug use, self-harm or violence;
- create multiple profiles per person;
- distribute commercial information;
- cause damage or nuisance to Users, Duetto Chat or others;
- make racist, intimidating or offensive statements;
- publicly disclose, reproduce or otherwise (re)use information from another user's profile without explicit permission of the relevant User;
- share login credentials with third parties, these are strictly personal.
If a Consumer acts in violation of article 3.1 or 3.2, Duetto Chat may terminate the Consumer's Membership and immediately modify, (partially) block or delete their profile. Duetto Chat will inform the Consumer of the block or deletion, stating the reason.
The Consumer accepts that Duetto Chat, if there is reasonable cause, may check the data provided by them and their behavior in connection with possible violations of article 3.1 and 3.2.
Article 4 - Complaints about Users; deception
- When Duetto Chat receives a report or complaint about a User, it investigates the complaint and takes appropriate measures if necessary. Duetto Chat strives to remove, modify or block profiles of Consumers that contain falsehoods, are misleading or that can otherwise clearly cause damage or nuisance to other Users.
- Duetto Chat strives to alert Consumers to possible deception by Users on Duetto Chat. The Website itself highlights risks and provides tips to prevent damage.
Article 5 - Protection of personal data
- The use of Duetto Chat is subject to the Privacy Statement of Duetto Chat. This describes how the Consumer's personal data is processed. Duetto Chat complies with the legal rules regarding privacy protection and cookie legislation.
- If Duetto Chat has reasonable suspicion of violation of the rules in article 3.1 and 3.2, and other Users (may) experience damage or nuisance as a result, Duetto Chat is entitled to access the data exchanged between Users via Duetto Chat. Duetto Chat elaborates on this in the Privacy Statement.
Article 6 - Liability
- Duetto Chat is liable to Consumers for damages resulting from a failure to perform, unless this failure cannot be attributed to Duetto Chat.
- The Consumer is liable to Duetto Chat for damages resulting from a failure by the Consumer to perform, for example as a result of violation of article 3, unless this failure cannot be attributed to the Consumer.
Article 7 - Consumer cancellation
- A paid Membership can be entered into for a specific period. After this period, the Membership may be tacitly renewed for an indefinite period. In case of tacit renewal, the Consumer may cancel the agreement at any time with a notice period of no more than one month. Duetto Chat explicitly points out this possibility of tacit renewal when entering into Membership.
- The paid Membership can be cancelled at the end of the first period and after that period at any time with a notice period of one day.
- The (paid) Membership can be cancelled via the Website or email, stating the Membership identification number known to Duetto Chat. Duetto Chat may ask the Consumer for further information if necessary to determine whether the cancellation originates from the Consumer. The Consumer will receive confirmation of their cancellation at the email address and/or phone number known to Duetto Chat.
- Regardless of whether the (paid) Membership has been cancelled, Duetto Chat will deactivate the Consumer's profile at the Consumer's request as soon as possible and in any case within two weeks of receiving the Consumer's request.
- The Consumer has 14 days after entering into Membership to exercise the right of withdrawal. If the Consumer exercises this right, but has already used the paid services of Duetto Chat during this period, Duetto Chat is entitled to charge a reasonable amount for the services consumed. This amount shall not exceed the subscription fee for a period of 1 month. Duetto Chat explicitly asks the Consumer for permission to commence services before the withdrawal period has expired and informs the Consumer of the amount that will be charged if the Consumer withdraws.
Article 8 - Complaints procedure
Duetto Chat strives to respond substantively to a submitted complaint within 10 business days.
